These Terms of Service (“Terms”) govern your use of Liberty Bancard’s (“Company,” “we,” “our,” or “us”) merchant services, payment processing solutions, and related offerings (collectively, the “Services”). By signing a merchant application, using our Services, or accessing our website, you agree to be bound by these Terms.
  1. Services Provided
Liberty Bancard provides payment processing and related merchant services, including but not limited to:
Credit/debit card acceptance (in-store, online, mobile).
Point-of-sale and terminal solutions.
Cash discount and compliant surcharging programs.
Settlement, funding, and reporting tools.
Customer service and support.
  1. Term & Termination
Services are provided on a month-to-month basis with no early termination fee (ETF).
You may cancel at any time by providing written notice to sales@libertybancard.com .
We may suspend or terminate services immediately for suspected fraud, regulatory violations, or failure to maintain an active merchant account in good standing.
  1. Merchant Responsibilities
By using our Services, you agree to:
Provide accurate and complete business, banking, and tax information.
Operate your business in compliance with all applicable federal, state, and local laws.
Maintain PCI-DSS compliance for handling cardholder data.
Use only approved and compliant equipment/software provided or authorized by Liberty Bancard.
Notify us promptly of any unauthorized use, breach, or suspected fraud.
  1. Fees & Pricing
Pricing is disclosed transparently as interchange-plus or compliant surcharging/cash discount programs.
There are no hidden fees; any applicable charges will be outlined in your merchant agreement.
Funding is typically provided on a same-day or next-business-day basis, depending on bank cutoff times.
  1. Data Security & Compliance
Liberty Bancard and its partners are PCI-DSS compliant.
You are responsible for ensuring your business maintains PCI compliance standards when handling sensitive cardholder information.
Failure to comply may result in fines from card networks, which remain the merchant’s responsibility.
  1. Liability & Disclaimers
Liberty Bancard is not liable for delays, interruptions, or losses caused by third-party processors, banks, or payment networks.
We are not responsible for chargebacks, retrievals, or losses arising from merchant error, fraud, or regulatory violations.
Services are provided on an “as is” and “as available” basis without warranties of any kind, unless expressly stated in writing.
  1. Indemnification
You agree to indemnify and hold harmless Liberty Bancard, its officers, employees, and affiliates against any claims, damages, or liabilities resulting from:
Your misuse of the Services.
Non-compliance with laws, card network rules, or PCI-DSS standards.
Any breach of these Terms.
  1. Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Any disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida.
  1. Changes to Terms
We may update these Terms at any time. Updates will be posted on our website with a new “Effective Date.” Continued use of the Services constitutes acceptance of revised Terms.
